These Terms of Service (“Terms”) govern your access to and use of the website at betterbell.care (the “Site”), operated by Ayan Sandybayev, doing business as BetterBell (“BetterBell,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms apply to the Site only. The BetterBell application is provided under separate terms and is not covered here. You can contact us by email at ayan@betterbell.care.
We may update these Terms from time to time. Changes take effect when we post the revised Terms with a new “Last updated” date; security-related changes may take effect immediately. Your continued use of the Site after changes take effect means you accept them. The Site is intended for users who are at least 18 years old.
1. The Site, and what it is not
The Site is an informational marketing website about BetterBell and its product. It is not intended for transmitting protected health information (PHI) or other regulated or sensitive data, and it is not a place to seek or receive care. Please do not submit such information through the Site or its contact form.
Neither the Site nor the BetterBell product provides medical advice, and neither is a substitute for professional medical care or judgment. The BetterBell product is not designed for urgent or emergency needs. In an emergency, call your local emergency number or contact your care provider directly.
2. Intellectual property
We own or license all content on the Site, including its text, designs, graphics, logos, trademarks, and software (collectively, the “Content”). We grant you a limited, non-exclusive, non-transferable, revocable license to view the Site and to print or download portions of it for your personal, non-commercial use or your internal business evaluation. Except as expressly allowed, you may not copy, reproduce, republish, distribute, sell, or otherwise exploit the Content without our prior written permission. All rights not expressly granted are reserved.
3. Feedback and submissions
If you send us a question, comment, suggestion, or other feedback, you grant us a non-exclusive, royalty-free, worldwide license to use it to operate and improve our products and services, with no obligation to you. Please do not send us confidential information that you do not want used in this way, and do not send anything unlawful, infringing, or that you do not have the right to share.
4. Acceptable use
When using the Site, you agree not to:
- use the Site for any unlawful purpose or in violation of these Terms;
- access areas or data you are not authorized to access, or interfere with or circumvent the security of the Site;
- systematically extract or scrape data from the Site to build a collection, database, or directory without our written permission;
- introduce malware, or otherwise disrupt, overload, or impair the Site;
- impersonate any person, submit false reports, or misuse any contact or support channel; or
- use information obtained from the Site to harass, abuse, or harm another person.
5. Privacy
Our Privacy Policy explains how we handle personal information collected through the Site and is incorporated into these Terms. The Site is hosted in the United States. By using it, you consent to the processing of your information in the United States as described in the Privacy Policy.
6. Third-party links
The Site may link to third-party websites or resources that we do not control. We are not responsible for their content, products, or practices, and your use of them is at your own risk and subject to their terms.
7. Disclaimers
THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ITS CONTENT IS ACCURATE OR COMPLETE.
As stated above, the Site does not provide medical advice, and the BetterBell product is not intended for urgent or emergency use.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD 100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
9. Indemnification
You agree to indemnify and hold harmless BetterBell from any claims, losses, liabilities, and reasonable attorneys’ fees arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.
10. Termination
We may suspend or restrict your access to the Site at any time if you misuse it or violate these Terms, or as needed for the security or proper functioning of the Site. The provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply after any termination.
11. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. If a dispute arises, you and we agree to first try to resolve it informally by contacting each other and negotiating in good faith for at least 30 days. If we cannot resolve it, the dispute will be handled exclusively by the state or federal courts located in the State of Georgia, and you consent to their jurisdiction and venue. Any claim must be brought within one (1) year after it arises.
12. California users
Under California Civil Code section 1789.3, California residents may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by mail at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
13. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a reorganization or transfer of our business. We are not responsible for delays or failures caused by events beyond our reasonable control. You agree that electronic communications and records satisfy any requirement that such communications be in writing.
